1. Acceptance of Terms
By accessing or using VM Hunter's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
VM Hunter provides an AI-powered voicemail detection service that analyzes audio streams to determine whether a call has been answered by a human or a voicemail system. The Service is provided via API access and may include additional features such as analytics and reporting tools.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your API keys and account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit malicious code or interfere with the Service
- Attempt to gain unauthorized access to our systems
- Use the Service for illegal telemarketing or robocalling
- Resell or redistribute the Service without authorization
5. Subscription Plans and Billing
VM Hunter offers the following subscription tiers:
- Free Plan: Limited calls per month at no cost, ideal for testing and evaluation
- Basic Plan: Suitable for small businesses with moderate call volumes
- Starter Plan: For growing teams with higher call volumes
- Professional Plan: For high-volume operations with advanced features
- Enterprise Plan: Custom volume and features - contact sales for details

Billing Terms:
- Subscription fees are billed in advance (monthly or annually)
- Your subscription automatically renews unless cancelled before the renewal date
- Upgrades are effective immediately; downgrades take effect at the next billing cycle
- We accept major credit cards and process payments securely via Stripe
- Failed payments may result in service suspension after 7 days
6. Refund Policy
Refunds are available under the following conditions:
- Refund requests must be submitted within 7 days of your first purchase
- You must have used less than 5% of your monthly call allocation
- Refunds apply only to the initial purchase, not renewals or subsequent payments

7. Service Level Agreement
We commit to maintaining 99.9% uptime for the Service. If we fail to meet this target, eligible customers may receive service credits as detailed in our SLA documentation. Enterprise customers may negotiate custom SLAs.
8. Intellectual Property
The Service, including all software, algorithms, and documentation, is the property of VM Hunter. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms. You retain ownership of any data you submit to the Service.
9. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the use of the Service. This includes API keys, technical specifications, and business information.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VM HUNTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Indemnification
You agree to indemnify and hold harmless VM Hunter from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to the Service will be revoked
- You remain responsible for any outstanding fees
- Provisions that should survive termination will remain in effect
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated with at least 30 days notice. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
